Our goal is to provide a mechanism to share information that can inform consumers and businesses about safe spaces and opportunities to elevate consumer experiences and hold ourselves accountable for respectful interactions. The only way that we can ensure that businesses are aware of how people from all demographic groups are being treated is for users to share information about their individual demographics. DLY provides data collected from the Sacki app to businesses in aggregate to help them better understand their consumer market. No individual user data is EVER shared.
What this Policy Covers
This Privacy Policy describes the privacy practices of the Sacki social platform that Different Like You, Inc., offers as a mobile application (the “App”). By visiting the Different Like You, Inc. website and domain name, Sacki application, and any other features, content, or application services offered from time to time by the Company in connection therewith (collectively, the “Sites”), or using any of our Services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. Capitalized terms not defined in this Privacy Policy shall have the meanings set forth in our Terms, available at https://www.differentlikeyouinc.com/.
“Company” or the terms “we” or “us” or similar terms refer to Different Like You, Inc. “You” or “your” or similar terms refer to you as a user of our Services.
By accepting our Privacy Policy when joining our App, or by visiting and/or using the Sites or any of our Services, you expressly consent to our collection, use, and processing of your Personal Information (as defined below) in accordance with this Privacy Policy.
As used in this Privacy Policy, the terms “using” and “processing” information include, among other things, subjecting the information to statistical or other analysis, and using or handling information in any way, including without limitation collecting, storing, evaluating, modifying, deleting, using, combining, disclosing, and transferring information within our organization or among our merchant members within the United States or internationally, as well as using personal information to respond to user requests.
How DLY defines Personal Information
This Privacy Policy covers how we use and disclose personally identifiable information that we gather from the time that you initially access our application. Personally, identifiable information refers to any information about you that can be used to contact or identify you, and information on your use or potential use of the application (collectively, “Personal Information”). This policy does not apply to the practices of third-party companies that we do not own or control, or to individuals that we do not employ or manage.
TYPES OF INFORMATION DLY COLLECTS
We receive and store any information you enter on our App or provide to us in several ways. Personal Information that we collect could include things like your name, mobile phone number, email address, location, IP address, browser information, username, password, certain sensitive data (Such as racial or ethnic data, sexual orientation, parental status, disability, language, religious or philosophical beliefs) and any other information or data that you provide when using our App. You can choose not to provide us with certain information, but that may result in our inability to provide you with personalized matching features in the App. DIY's goal is to use the Personal Information that you provide for such purposes as personalizing the user experience and communicating with you about our APP, including updates and new features.
How DLY UseS Personal Information
We use personal information for the following purposes in the following ways.
Provide our services, including:
Invite you to our App;
Operate the App and our business;
Maintain, improve, and develop the App and the App’s features;
Create and maintain your account;
Match reviews;
Recommend merchants and businesses that might be of interest to you;
Communicate with you about the App by sending you to push notifications with announcements, updates, security alerts, support, and administrative
messages, if you have enabled that functionality;
Provide support for the App, and respond to your requests, questions, and feedback; and
Direct marketing. We may send you direct marketing communications as permitted by law, including, but not limited to, notifying you of feature releases
and special events. You may opt out of our email marketing communications as described in the “Opt-out of marketing communications” section below.
Please note that we may periodically send you service emails even after you opt out of direct marketing.
Research and development. We may create and use de-identified information for our business purposes, including analyzing the effectiveness of our App,
improving and adding features to our App, and analyzing the general behavior and characteristics of users of our App.
Support and Maintenance. We use third-party analytics services to automatically log certain information about your mobile device and how you interact
with the App. The information collected is used to troubleshoot and prevent errors, perform data analysis, and develop new features.
Compliance and protection. We may use personal information to:
o Protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims);
o Enforce the Terms of Service that govern the App;
o Enforce our Community Guidelines by investigating potential violations;
o Audit our internal processes for compliance with legal and contractual requirements and internal policies;
o Prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft; and
o Comply with applicable laws, lawful requests, and legal processes, such as responding to subpoenas or requests from government authorities.
Personal Information shared by DLY
We do not sell personal information. In the ordinary course of business, we may share personal information with:
Service providers. Companies and individuals that provide services on our behalf or help us operate the App or our business (such as hosting, analytics,
consumer support, email, and SMS delivery).
Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that
they render to us.
Authorities and others. Law enforcement, government authorities, and private parties as we believe necessary to (a) protect our, your, or others’ rights,
Privacy, safety, or property (including by making and defending legal claims); (b) enforce the Terms of Service that govern the App, and (c) protect,
investigate and deter fraudulent, harmful, unauthorized, unethical, or illegal activity.
Subsidiaries and affiliates. If we were to engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that
involves the transfer of the information described in this Policy, we may share your information with a party involved in such a process (for example, a
potential purchaser).
De-identified Information: We may create De-Identified Information from the information that you share with us and use such De-identified Information
without restriction. Again, we never disclose aggregate information in a manner that would identify you personally.
With Your Consent: Except as set forth above, you will be notified when your Personal Information may be shared with third parties and will be able to
control the sharing of this information.
Personal Information Shared by You (the User)
When you establish an account on the App, you share certain of your profile information with the community on our App and on the web. This information includes your profile picture, bio, username, and the reviews you have contributed to the App.
PERSONAL INFORMATION SECURITY
You use the App at your own risk. We implement appropriate technical, administrative, and organizational measures to protect personal information, both online and offline, from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Furthermore, your individual user account is protected by a password for your privacy and security. To ensure that there is no unauthorized access to your account and Personal Information, we suggest that you safeguard your password appropriately. However, no Internet or e-mail transmission is ever fully secure or error-free. In particular, e-mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Internet. Please keep this in mind when disclosing any personal information to us via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the App; or on third-party websites. Finally, we cannot control the actions of users on the platform, who may seek to use third-party apps or devices to record, store, or share content or communication without other users' prior consent. Please keep this in mind when using the App.

UPDATING OR DELETING YOUR PERSONAL INFORMATION
Update, correct, or delete. You can contact us to ask us to update or correct your information. You may also delete your account or request that we delete the Personal Information you previously shared with DLY. Please note that we will need to verify that you have the authority to update, correct, or delete the account, and certain activity generated prior to deletion may remain stored by us and may be shared with third parties as detailed in this Privacy Policy. You may also:
Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions contained in the
communications we send you.
Opt-out of push notifications. If you opt-in to receive push notifications within the App, we may send push notifications or alerts to your mobile device from time to time. You can deactivate push notifications and alerts at any time by changing your device settings, changing the push notification settings within the app, or deleting the App.
CHILDREN UNDER THE AGE OF 13
The Services are not directed to children. We do not knowingly allow or solicit anyone under the age of 13 to participate independently in any of the Services. We do not knowingly collect Personal Information from children. If a parent or guardian becomes aware that his or her child has provided us with Personal Information, please contact us at info@differentlikeu.com. If we become aware that a user of the Services is under the age of 13 and has provided us with Personal Information without verifiable parental consent, we will delete such Personal Information from our records.
CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the App. If required by law, we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the App. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated, at the time of posting).
